THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.12296 of 2017 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner-A.2 seeking to quash the order dated 31.03.2016 passed in C.C. No.114 of 2014 on the file of the XII Additional Chief Metropolitan Magistrate, Hyderabad. 2.

Heard the learned counsel for the petitioner-A.2 and the learned Assistant Public Prosecutor, apart from perusing the material on record.

Learned counsel for the petitioner-A.2 would submit that the Court below issued NBW against the petitioner-A.2 in C.C. No.114 of 2014 which is pending execution; the petitioner-A.2 is working in United States of America; he intends to come back to Hyderabad and get the NBW recalled as per the procedure established; the apprehension of the petitioner is that when once he lands here, the police would arrest him and in such event, the U.S.A. Government will not receive him back. 4.

Under the above circumstances, the Station House Officer, Central Crime Station, Hyderabad, concerned is directed not to execute the NBW issued against the petitioner-A.2 in C.C. No.114 of 2014 on the file of the XII Additional Chief Metropolitan Magistrate, Hyderabad, for a period of three weeks from today, enabling the petitioner to workout his remedies under law.

With the above direction, this Criminal Petition is dismissed accordingly. Miscellaneous petitions, if any pending in this case, shall stand closed.
