THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.42609 of 2017 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents. The petitioner was initially appointed as Village Revenue Officer in January, 2002. While he was working as Village Revenue Officer at Peddampet Cluster of Mancherial Mandal, he was kept under suspension by the then District Collector, Adilabad, by proceedings dated 20.05.2016. A charge memo was issued on the same day. The petitioner submitted his explanation on 04.06.2016. An enquiry officer was appointed on 16.07.2016 and he submitted his report. Thereafter, a show cause notice was issued on 18.09.2017 proposing to impose the punishment of withholding three increments of pay without cumulative effect and the petitioner submitted his representation on 22.09.2017. Without considering the said representation, the punishment was imposed on 10.10.2017. The petitioner preferred an appeal to the first respondent on 10.11.2017. When the said appeal is pending, the present Writ Petition is filed challenging the order of punishment dated 10.10.2017.

Since the appeal is pending before the first respondent against the same order of punishment, this Court is not inclined to entertain the present Writ Petition, but directs the first

respondent to consider and dispose of the appeal preferred by the petitioner in accordance with law as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 15.12.2017 vs
