THE HONOURABLE SRI JUSTI CE SANJAY KUMAR AND THE HONOURABLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON No.46637 of 2018 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) Andhra Pradesh Panchayat Raj Diploma Engineers Association is the petitioner. It filed O.A.No.1210 of 2018 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad, aggrieved by the inaction of the respondent authorities in considering its representation dated 23.05.2017. A consequential direction was sought to the authorities to consider the said representation and pass appropriate orders thereon. However, by order dated 25.06.2018, the Tribunal dismissed the O.A. Hence, the petitioner Association is before this Court.

Perusal of the order under challenge reflects that the Tribunal considered the merits of the petitioner Association's representation and opined that it did not warrant consideration. With due respect to the Tribunal, when the grievance of the petitioner Association was only with regard to the inaction on the part of the authorities in considering its representation, it was not within the scope of the O.A. for the Tribunal to consider the merits of the said representation and render a finding thereon.

The order under challenge is accordingly set aside and the writ petition is disposed of directing the respondents to consider the representation dated 23.05.2017 submitted by the petitioner Association on its own merits and in accordance with law and take a decision thereon. Needless to state, grievances of employees would have to be considered on priority and the same cannot be kept pending indefinitely causing heartburn and leading to unrest amongst employees. The respondents

shall therefore take an appropriate decision on the pending representation expeditiously and in any event, not later than six weeks from the date of receipt of a copy of this order.
