This writ petition is filed challenging the order in letter No.105/2017/G, dated 30-01-2017, wherein and whereby fair price shop authorization of the petitioner was suspended pending enquiry.

Learned counsel for the petitioner submits that as on today no show-cause notice is issued and enquiry is not concluded. Though the petitioner has filed appeal on 14-02-2017 against the impugned order, no orders are passed.

Heard learned Assistant government Pleader for Civil Supplies who seeks time for getting instructions. It is to be seen that this Court in K.Nirmala V. The Revenue Divisional Officer, Ananthapur District1 has taken a view that normally suspension of fair price shop authorization pending enquiry cannot be continued beyond (90) days. In view of the same, impugned order is set aside. However, this order will not preclude the competent authority from taking action against the petitioner in accordance with law. Accordingly, the writ petition is allowed to the extent indicated above.
