HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.39693 OF 2017 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the 3rd respondent in not restoring the petitioner's fair price shop No.88, situated at Rajamahendravaram Urban, East Godavari District in pursuance of the notice in Ref.(D) 4786, dated 17.10.2017 and the willingness of the petitioner dated 20.10.2017 to run the F.P.Shop No.88, as illegal and arbitrary and for a consequential direction to the 3rd respondent to consider the willingness of the petitioner to run the said shop.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies.

Since it is stated that in pursuance to the notice dated 17.10.2017 the petitioner submitted representation dated 20.10.2017 expressing his willingness to run the fair price shop No.88, without expressing any opinion on merits, the writ petition is disposed of directing the 3rd respondent to consider the said representation of the petitioner and pass orders, in accordance with law, if not already passed.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
