The Hon'ble Sri Justice A.Rajasheker Reddy Writ Petition No.40813 of 2017 Order:

This Writ Petition is filed for a Mandamus to declare the action of the respondents, in not releasing the seized stock by considering the bank guarantee to its value to be furnished by the petitioner, as illegal and arbitrary. Heard the learned Counsel for the petitioner and the learned Assistant Government Pleader for Agriculture (TS) appearing for respondent Nos.1 to 4.

The learned Assistant Government Pleader for Agriculture (TS) submitted that the petitioner has not filed any application seeking release of the seized stock and that without approaching the authorities, he has straight away filed this Writ Petition.

In view of the same, the Writ Petition is disposed of granting liberty to the petitioner to file an application before the competent authority seeking release of the seized stock. On such an application being filed, the competent authority shall consider and dispose of the same expeditiously in accordance with law.

ARR, J W.P.No.40813 of 2017 Dt: 11-12-2017 As a sequel, Miscellaneous Petitions, pending if any, stand disposed of as infructuous.
