HONOURABLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.13787 of 2018 ORDER :

Heard before admission and before notice to the 2nd respondent/de facto complainant.

The only grievance of the petitioner is the summon issued was not served within the date fixed for next hearing, from which the trial Court issued warrant in the case covered by private complaint for the offence under Section 138 of the Negotiable Instruments Act. Once such is the case, remedy of the petitioner is to approach the trial Court by personal appearance for warrant recall to allow under Section 70(2) Cr.P.C. and to execute bond for future appearance with or without sureties being directed by the trial Court as contemplated by Section 88 or 89 Cr.P.C.
