THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.13773 OF 2018 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C), is filed by the petitioner/A.4, for grant of anticipatory bail in the event of his arrest in connection with Crime No.1440 of 2018 of Rajendranagar Police Station, Cyberabad District, registered for the offence punishable under Section 20 (b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard learned counsel for the petitioner/A.4, the learned Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioner/A.4 would submit that the petitioner/A.4 is nothing to do with the alleged seizure of Ganja from the possession of accused Nos.1 to 3; that the petitioner/A.4 was falsely implicated in this case and ultimately prayed to allow the application.

Learned Additional Public Prosecutor opposed the grant of bail to the petitioner/A.4.

As per the material placed on record, accused Nos.1 to 3 were apprehended on 17.09.2018 and 6 kgs., of Ganja was seized from their possession under the cover of panchanama. There is confession of A.1 that this petitioner/A.4 is procuring ganja from Adilabad District and selling the same in Hyderabad to make illegal money. There is allegation against this petitioner/A.4 in indulging,
procuring and selling of ganja to make illegal money. It is a serious offence, which requires custodial interrogation. Therefore, the application is devoid of merit and is liable to be dismissed. 6.
Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
