THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.NO.42811 OF 2017 ORAL ORDER (Per the Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, petitioner seek direction thereby directing the respondents to forthwith implement the order of the learned Tribunal dated 17.03.2011 in O.A.No.2470 of 2004.

The learned counsel for the respondents submit, that the aforesaid order has been challenged before this court in W.P.No.2981 of 2011 and the same is pending adjudication.

This court put a specific query to the learned counsel for the respondents that whether any interim order has been passed in the aforesaid writ petition. The learned counsel replied in the negative. Since the order dated 17.03.2011passed by the Tribunal holds the field, the respondents are duty bound to comply with the said order. However, till date, the order has not been complied with. In the interest of justice, we hereby direct the respondents to comply with the order dated 17.03.2011 passed by the Tribunal in O.A.No.2470 of 2004, within four weeks from the date of receipt of a copy of this order.

It is needless to state that while complying with the order, the respondents are at liberty to mention that the compliance of the order of the Tribunal shall be subject to out come of W.P.No.29881 of 2011 pending before this court for adjudication.
