Crl.P.M.P.Nos. 13307 and 13308 of 2017 These two Petitions are filed under Sections 320(6) and 320(2) Cr.P.C. seeking leave of this Court to compound the offences punishable under Sections 403, 406, 420, 506 r/ w 34 IPC and to record compromise in C.C.2 of 2017 on the file of XIII Metropolitan Magistrate at L.B.Nagar, R.R. District.
Learned counsel for the petitioner submits that the petitioner is not one of the directors of the company and he is noway concerned with the crime and requested this Court to quash the proceedings against him.
De facto complaint and the accused No.3 are present in person and they are identified by their respective counsel and they also produced the copies of Aadhar Cards in proof of their identity. On enquiry, the de facto complainant stated that the petitioner is noway concerned with the offence and requested this Court to quash the proceedings against the petitioner/ A.3. Since the request of the de facto complainant and his counsel is voluntarily, and it is not against the society and it is purely personal in nature, I find that it is a fit case to grant permission to compound the said offences, following the guidelines of Apex Court in Par bat bh ai Aah ir v St at e of Gu j ar at 1.

Accordingly, these two Petitions are allowed permitting the parties to compound the said offences to record compromise. Cr l.P.No.1 2 0 0 8 of 2 0 1 7 In view of the Orders passed in Crl.P.M.P.Nos. 13307 and 13308 of 2017, this Criminal Petition is allowed and the proceedings in C.C.2 of 2017 on the file of XIII Metropolitan Magistrate at L.B.Nagar, R.R. District, are hereby quashed. The Registry is directed to annex a copy of the joint compromise memo to the present petition. As a sequel, miscellaneous petitions, if any, pending in this case, shall stand dismissed.
