THE HONOURABLE SRI JUSTICE C.V. BHASKAR REDDY Contempt Case No.2511 of 2017 ORDER:

This Contempt Case is filed by the petitioners alleging wilful disobedience of the order passed by a learned Single Judge of this Court in Writ Petition No.17092 of 2017, dated 02.06.2017.

Vide above order, the learned Single Judge directed the 2nd respondent therein to act upon the representations made by the petitioners, and if the allegations made therein are true, then the 2nd respondent shall take necessary action against the unauthorized constructions made therein.

Alleging violation of the above order, the petitioners have filed the present Contempt Case.

On 13.07.2018, Notice in Form-I was issued to the respondent in the Contempt Case. Subsequently, on 24.08.2018, the contemnor / respondent was present in

the Court, and sought time to file counter-affidavit in the matter.

Counter-affidavit was filed by the respondent on 15.09.2018, contending that as per the road-map submitted by the Singareni Collieries Company Limited (S.C.C.L.), the respondent had inspected the said area and found that there is no encroachment on the said 30" feet road at Ambedkar Junction, and the same was intimated to the petitioners vide proceedings dated 03.05.2018; and tendered unconditional apology to this Court for not complying with the order passed by the learned Single Judge of this Court in Writ Petition No.17092 of 2017, dated 02.06.2017, in time.

This fact is not disputed by the learned counsel for the petitioners.

In view of above, this Court is of the considered view that the cause in the Contempt Case no longer survives for adjudication, and hence the same is closed as no further orders are necessary in the Contempt Case. No costs.
