THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 46758 of 2018 O R D E R :

To declare the action of the 4th respondent Tahsildar in trying to demolish / dispossess the petitioners from their respective houses situated at Chowdeswari Colony, Hindupur Town, Anantapur District, without following due process of law, as illegal and arbitrary, the Writ Petition is filed. Heard learned counsel for the petitioner and learned Government Pleader for Revenue (Andhra Pradesh). It is submitted across the Bar that in similar circumstances, dealing with Writ Petition No. 4548 of 2017, in respect of the premises situated at Chowdeswari Colony, Hindupur Town, this Court, vide order dated 09.03.2017, recording the undertaking given by the 4th respondent therein to follow the procedure stipulated by law and remove the encroachments in Channel Poramboke in Survey No. 435 of Kotnur Village of Hindupur Mandal, disposed of the Writ Petition.

In view of the above, since admittedly, the subject premises are situated at Chowdeswari Colony, the 4th respondent Tahsildar is directed to follow the procedure stipulated by law before resorting to demolish / dispossess the petitioners from their respective houses.

The Writ Petition is accordingly, disposed of. No costs . Consequently, the miscellaneous Applications, if any shall stand closed.
