THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.47221 of 2018 ORDER:
The prayer of the petitioners in this case reads as under: 'For the reasons stated in the accompanying affidavit filed in support of the present Writ Petition, it is therefore prayed, that this Hon'ble Court may be pleased to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not disposing of the representation of the petitioners dated 22.05.2018 and 27.06.2018 made to Joint Collector, Kamareddy and Revenue Divisional Officer Kamareddy as illegal, arbitrary and in violation of principles of Natural Justice and consequently directing the respondents Nos.2 and 3 i.e.
, Joint Collector, Kamareddy and Revenue Divisional Officer, Kamareddy to dispose the said representation of petitioners and consequently to restrain them from further alienation/mutation in respect of lands admeasuring Ac.109.00 acres in survey Nos.63/A/1 to 76/A1 in the outskirts of Brahmajiwadi Village, Thadwai Mandal, Kamareddy District and to pass such other Order or orders as this Hon'ble Court may deem fit and proper in the interest of justice.'
It appears that the petitioners have chosen to make representations to the appellate and revisional authorities under the Telangana Rights in Land and Pattadar Pass Books Act, 1971, though they are provided with effective statutory remedies of appeal and revision thereunder if they are aggrieved by the entries made in the revenue records in relation to the subject land. Without availing such statutory remedies, it is not open to the petitioners to baldly file representations before the authorities concerned and seek disposal of such representations behind the back of the affected parties. The writ petition is accordingly dismissed leaving it open to the petitioners to invoke the statutory remedies available to them in accordance with law, if they so choose.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
