THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.13807 OF 2018 ORDER:

In this Petition filed under Section 482 Cr.P.C., the petitioner/accused No.1 seeks to quash the proceedings against him in FIR No.154 of 2018 of Thulluru Police Station, Guntur District, registered against him for the offence under Section 420 IPC. 02.

Investigation is reported to be pending.

When the matter came up for hearing, learned counsel for the petitioner, without insisting for quashment, would request that the protection as envisaged under Section 41-A Cr.P.C. may be extended to the petitioner and he is ready to cooperate with the investigating agency for smooth completion of investigation.

In view of the said submission of learned counsel for petitioner, the Investigating Officer is directed to scrupulously follow the guidelines rendered by the Hon'ble Apex Court in the decision reported in Arnesh Kumar v State of Bihar1 and also the procedure contemplated under Section 41-A Cr.P.C. during the course of investigation towards the petitioner/accused. In turn, the petitioner/accused shall cooperate with the investigating agency for smooth completion of investigation.
