Heard counsel for petitioner and Government Pleader for Assignment for respondents.
Petitioner has assailed in the Writ Petition the order dated 07.10.2017 of third respondent rejecting the petitioner's application dated 06.09.2017 for mutation and for issuance of title deeds and e-passbook without assigning any reasons. Since the said action of the third respondent visits the petitioner with civil consequences, giving of hearing as well as providing reasons for rejection of petitioner's application is mandatory, since reasons would indicate application of mind by third respondent to the case of the petitioner. Thus, it has also not complied with the principles of natural justice. Therefore, the Writ Petition is allowed with costs of Rs.2,000/- (Rupees two thousand only) to be paid by the third respondent to the petitioner within four (4) weeks from today. The third respondent is directed to pass a reasoned order regarding the petitioner's application for mutation and issuance of title deeds and e-passbook within four (4) weeks from the date of receipt of a copy of this order and communicate it to the
petitioner. Miscellaneous petitions, if any, pending shall stand closed.
