THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 41407 of 2017 O R D E R:
This writ petition is filed for the following relief: "... to issue a writ, order or direction more particularly one in the nature of writ of Mandamus directing the respondents herein to release and to pay the compensation amount to the petitioners in respect of their acquired lands under Section 4 (1) of the Land Acquisition Act, dated 15.02.2000, by releasing the funds forthwith as per the draft award submitted by the 5th respondentLand Acquisition Officer in letter No.E1/5520/1990, dated 27.12.2016, and forwarded by the 4th respondent-District Collector through letter No.G1/681/2017, dated 24.02.2017, by declaring the joint and collective inaction of the respondents in releasing the amount for payment of compensation amount to the petitioners, as illegal, arbitrary, unjust and violative of Articles 14, 21 and 300-A of the Constitution of India..."
When the matter is called, it is represented by the learned counsel for the petitioner that the issue in the present writ petition is squarely covered by the order, dated 26.12.2017, passed by this Court in W.P.No.43993 of 2017.
A perusal of the said order reflects that similarly situated persons approached this Court by way of filing the said writ petition and this Court disposed of the same with the following direction:
"Having regard to the aforesaid facts and circumstances, respondent No.1 is directed to consider the proposal sent by respondent No.4, dated 28.02.2017, and take
action for release of the compensation amounts payable to the petitioners, within a period of eight weeks from the date of receipt of a copy of this order."
Following the above said order and for the reasons recorded therein, this writ petition is also disposed of directing respondent No.1 to consider the proposal sent by respondent No.4, dated 24.02.2017, and take action for release of the compensation amount payable to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order.
Office to enclose a copy of the order in W.P.No.43993 of 2017 to this order.
