Heard Mr.Venumadhav, for revision petitioner. Aggrieved by the order dated 03.10.2017 in I.A.No.795 of 2012, the present revision petition is filed. The petitioners through I.A.No.795 of 2012 prayed for condoning the delay of 3504 days in filing an application to set aside the ex-parte decree dated 08.04.2003. The suit is one for perpetual injunction.
I have perused the affidavit filed in I.A.No.795/2012 and also the reasons assigned by trial Court for rejecting the prayer in I.A.No.795 of 2012. This Court is in complete agreement with the findings recorded by the trial Court. Hence, the Civil Revision Petition is dismissed. Mr.Venumadhav submits that the suit is one for perpetual injunction and the remedies available to petitioners herein for seeking comprehensive declaration or protection of their possession may be left open. This Court in the present Civil Revision Petition considers the order of the trial Court in I.A.No.795 of 2012. The petitioners are certainly entitled to workout their remedies in accordance with law, on any of the grievances
including interference by respondent herein. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
