HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.13856 OF 2018 ORDER:

The petitioner/accused seeks to quash the proceedings against him in Crime No.77 of 2018 of Gudibanda Police Station, Anantapur District, registered for the offences under Sections 420, 468 and 471 IPC.

Having regard to the nature of accusations and sections of law under which the attribution is made against the petitioner, this Court is of the considered view that the investigation shall go on to reach its logical conclusion. However, the investigating officer, during the course of investigation, shall scrupulously follow the procedure contemplated under Section 41A Cr.P.C. and also the guidelines issued by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1. However, it is made clear that the petitioner/accused shall cooperate with the investigating agency for smooth completion of investigation. 4.

Accordingly, with the above directions, this criminal petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
