HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.42745 OF 2017 ORDER:

The case of the petitioner is that the petitioner has obtained lease of agricultural land of Ac.4-10 cents in Sy.Nos 151/1, 652/3 and 651/2 from one K.Balaraju and others and doing pawn culture in the leased premises by obtaining electricity service connection in the name of K.Balaraju. The respondent-authorities issued provisional assessment notice dated 31-05-2016 to said Balaraju and W.P.No.38827 of 2016 is filed against the same. The said writ petition was disposed of by this Court by order dated 10-11-2016 with a direction to the petitioner therein to deposit Rs.5,87,835/- and there was stay of disconnection. The said amount has been paid. However, when the electricity bills for the subsequent months are not paid, the respondent-authorities disconnected the power supply and when the petitioner paid arrears of Rs.1,20,634/- and made representation on 16-11-2017 for restoration of power supply. But the same is not considered. Aggrieved by the same, the present writ petition is filed.

Heard learned counsel for the petitioner and learned Standing Counsel for the respondent-Corporation.

Even as per the impugned proceedings dated 18-11-2017, it shows that Rs.5,87,835/- was paid in terms of orders in WP.No.38827 of 2016 and since the petitioner has not paid arrears of Rs.1,20,634/- , power connection was disconnected. Since it is stated that the petitioner has paid Rs.1,20,634/- on 13-11-2017, the respondent-authorities are directed to restore the power supply to the petitioner. However the petitioner is liable to pay the balance amounts after the same is determined by the Special

Court under Section 154 of the Electricity Act. The petitioner shall pay the regular bills, failing which it is open for the respondents to take appropriate action in accordance with law. With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
