It is the case of the petitioners that they are absolute owners and possessors of house sites admeasuring Ac.0-05 cents each in Survey Nos.309/1A2 and 309/1A1 of Chinnamandem Revenue Village, Chinnamandem Mandal of Y.S.R. Kadapa District, having been assigned the same by proceedings dated 12.06.1985 issued by the predecessor-in-office of 4th respondent. It is their further case that since the date of grant, they are in possession and enjoyment of the house sites by constructing houses and cattle sheds, and as the houses became old and are in dilapidated condition, they have dismantled the old houses and started new construction. While so, the 4th respondent objected the petitioners and insisted them to vacate from their respective house sites stating that the subject lands are required for expansion of Mandal Office. 2.
Heard Sri Uyyuri Mani Varun, learned counsel for the petitioners, and the learned Government Pleader for Revenue, State of Andhra Pradesh. 3.
In the light of the submissions made and taking into consideration the petitioners assertion that they are in occupation of house sites as stated in their affidavit, the writ petition is disposed of with a direction to the respondents not to interfere with the petitioners possession and enjoyment over the subject lands, without following due process contemplated under law.
