HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.46797 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the third respondent in threatening the petitioner to vacate the shop bearing Door No.18/ 61, Opposite State Bank of Achari Veedhi, Nellore, within a period of one week, as illegal and arbitrary. 2) The grievance of the petitioner is that without issuing any notice, the third respondent is threatening the petitioner to vacate the shop immediately and hence seeks a direction to the third respondent to follow due process of law. 3) Having regard to the facts and circumstances of the case and without going into the merits of the case, if the shop exists and if the petitioner is in possession of the same, any coercive action to be taken by the third respondent shall be in accordance with the procedure established under law.

4) Accordingly, the writ petition is disposed of. No order as to costs.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
