HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI CONTEMPT CASE No.3500 of 2018 ORDER :

When the matter is taken up for hearing, learned counsel for the petitioners submits that the respondents have not passed any orders in pursuance of the order dated 04.10.2018 in W.P.No.1337 of 2009 passed by this Court and contends that appropriate action be initiated against the respondents and punish them under Sections 10 to 12 of the Contempt of Courts Act.

The learned Advocate General appearing for the respondents had contended that pursuant to the order dated 04.10.2018 passed by this Court, the respondents have considered the cases of the petitioners by placing the matter before the Board of Directors, which had considered the cases of the petitioners and rejected the same vide order dated 27.11.2018. If the petitioners are aggrieved by the said rejection order dated 27.11.2018, they may challenge the said rejection order in appropriate proceedings.

Having considered the rival submissions made by the learned Counsel for the respective parties, this Court is of the considered view that the respondents have complied with the order dated 04.10.2018 passed by this Court by placing their matter before the Board of Directors, which had considered the cases of the petitioners and rejected the same vide order dated

AKS, J C.C.No.3500 of 2018 27.11.2018. If the petitioners are still aggrieved by the said rejection order dated 27.11.2018, they are at liberty to challenge the said rejection order in appropriate proceedings. Thus, there is no deliberate and wilful violation of any Court orders. Accordingly, the Contempt Case is closed.
