This writ petition is filed for the following relief: "to issue writ, order or direction more particularly one in the nature of writ of mandamus to declare the action of the 3rd respondent in threatening the petitioner to vacate the tea stall in the name and style of Pariwar Chai Corner in Door bearing No.19/3, Ward No.18, Achari Veedhi, Opp. State Bank, Nellore within a period of one week, otherwise the belongings will be thrown out, as illegal, arbitrary and unconstitutional and consequently to direct the respondents No.2 and 3 not to evict the petitioner from the shop bearing Door No.19/3, Ward No.18, Achari Veedhi, Opp. State Bank, Nellore without following due process of law".

Though various grounds are raised, the learned counsel for the petitioner restricts his prayer, seeking a direction to the respondent authorities, not to demolish or evict him from the premises, without following the due procedure of law. 3.

Standing counsel for respondent Municipality submits that any action to be taken by the authorities shall only be in accordance with law.

Recording the submissions, the writ petition is disposed of, directing the respondents herein to follow due process of law, in case they intend to evict the petitioner from the premises or demolish the structure.
