THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.41072 OF 2017 ORDER:

Heard learned counsel for the petitioner and the learned counsel for the respondents.

In spite of granting time from 05.12.2017, neither instructions were received by the learned counsel for respondents nor counter affidavit is filed.

The case of the petitioner is that he obtained B.Tech., from Narasaraopet Engineering College, affiliated to JNTU, Hyderabad, in the year 2008 and thereafter, he secured M.Tech., from Karunya University, Coimbatore, in 2011. He was appointed as Assistant Professor in the Department of Electronics and Instrumentation Engineering on 05.12.2011. While he was working as Assistant Professor, he joined Jagadishprasad Jhabarmal Tibrewala University, Jhunjhu, State of Rajasthan, in the year 2015 for pursuing Ph.D., in the subject Electronics and Communication Engineering (ECE) and secured the said degree in February, 2017. He submitted the same to the fourth respondent for the purpose of recording in the Service Register and also for considering his case for promotion.

Since the degree obtained by him was from a University outside the State, the fourth respondent addressed a letter on 08.03.2017 to the second respondent drawing the attention of the third respondent duly enclosing the certificate of the petitioner and requesting the second respondent to confirm whether the University from where the petitioner obtained his Ph.D., was a recognized University for the purpose of appointments and promotions in the University service. When there was no response from the second respondent, the petitioner submitted two representations on 21.08.

and 11.10.2017. When there was no response, the present writ petition was filed.

As stated above, there is no response from the second respondent even after filing the writ petition. In the circumstances, this Court is constrained to dispose of the writ petition by directing the second respondent to consider the representations of the petitioner dated 21.08.2017 and 11.10.2017, take necessary action and communicate the decision to the petitioner within a period of six weeks from the date of receipt of copy of this order. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs.
