HON'BLE SRI JUSTICE S.V. BHATT W.P. No.40420 OF 2017 ORDER:

Heard Mr.P.Suresh for petitioner and the Assistant Government Pleader (Home).

The petitioner prays for the following relief: "...Writ of Mandamus directing the 2nd respondent to take action in accordance with law ..."

The complaint of petitioner is that 2nd respondent even assuming a complaint is received against petitioner is required to follow the procedure stipulated by law but ought not to phone or summon the petitioner to Police Station without a crime being registered against petitioner. The Assistant Government Pleader on instructions submits that on 11.10.2017 a complaint against petitioner was received, entry in General Diary was made and later on the complainant and the petitioner since had compromised, the matter was not enquired into further by 2nd respondent. Again on 23.11.2017, another complaint is received, General Diary entry is made and enquiry is underway. If at all the presence of petitioner is required, the 2nd respondent would follow the procedure prescribed by law.

The statement of Assistant Government Pleader is placed on record and the writ petition is disposed of accordingly. No order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
