THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.40344 of 2017 ORDER :

This writ petition is filed with the following prayer: " ...to issue a Writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents 3 and 4 in insisting on the petitioner to get occupancy certificate for the purpose of releasing electricity supply to the premises of the petitioner bearing municipal Plot No.356, Sy.No.33,34, 35P,36 to 39, situated at Sarojini Naidu Nagar, Guttala Begumpet Village, Serlingampally Mandal, Ranga Reddy District, as being illegal, arbitrary and consequently, direct respondent No.3 and 4 to release power supply to the petitioner premises without insisting for production of occupancy certificate from respondent No.5 and be pleased to grant such other order or orders as this Hon'ble Court may deems fit and proper in the circumstances of the case."

Heard learned counsel for the petitioner who submits that the 'lis' in the writ petition is squarely covered by the order dated 14.09.2017 passed by this Court in WP.No.31189 of 2017; and the same is not disputed by Sri R.Vinod Reddy, learned Standing Counsel for respondents 2 to 4.

Sri Sampath Prabhakar Reddy, learned Standing Counsel appeared for the 5th respondent.

Recording the aforesaid submission of the learned counsel, the writ petition is disposed of with a direction to respondents to release the power supply to the premises of the petitioner subject to the compliance of the terms and conditions of supply and on

furnishing an undertaking to produce the occupancy certificate from the concerned Municipality/Municipal Corporation, within a period of three months, and if no such occupancy certificate is produced within such period, it is open to the respondents to take appropriate action for withdrawal of power supply in accordance with law. No order as to costs.

Consequently, Miscellaneous Petitions pending, if any, shall stand closed.
