O R D E R

Aggrieved by the action of the 4th respondent - Sub Registrar, Vinukonda, Guntur District, in refusing to receive and register the document presented by the petitioner in respect of subject property bearing Door No.30-705 in Sy.No.398/ 1, admeasuring 121 sq. yards situated in Vinukonda Town and mandal, Guntur District, by placing reliance on the proceedings issued by the 2nd respondent - Commissioner and Inspector General of Stamps and Registration vide draft memo No.G2/ 19134/ 2011 dated 01.12.2011, the present writ petition is filed. Learned counsel for the petitioner submits that the lis in the present writ petition is squarely covered by the order of this court dated 07.12.2015 in W.P.No.39537 of 2015 and batch and that the present writ petition may also be allowed in terms of the said order.

Learned Assistant Government Pleader for Registration and Stamps does not dispute the same.

In view of the same and for the reasons alike, the present writ petition is allowed setting aside the memo No.G2/ 19134/ 2011 dated 01.12.2011 issued by the 2nd respondent. There shall be a consequential direction to the 4th respondent - Sub Registrar, Vinukonda, Guntur District, to receive and process the documents presented by the petitioner in respect of the subject property, without reference to the order dated 15.03.2011 of the High Court of Madras in Contempt Petition No.1205 of 2010. In the event, the documents presented are found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899,

the Sub-Registrar, Vinukonda, Guntur District, shall complete the registration formalities and release the document, in accordance with due procedure.

Interlocutory applications pending, if any, shall stand closed. No costs.
