THE HON'BLE Dr . JUSTI CE SHAMEEM AKTHER CRI MI NAL PETI TI ON No.1 3 9 9 5 of 2 0 1 8 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused seeking to call for the records relating to Docket order, dated 18.12.2018, passed in Crl.M.P.No.5709 of 2018 in S.C.No.471 of 2015 on the file of Metropolitan Sessions Judge, Cyberabad, Ranga Reddy District at L.B.Nagar, and quash the same. 2.

Heard the learned counsel for the petitioner/ accused, the learned Assistant Public Prosecutor representing the respondentState and perused the record. 3.

The contention of learned counsel for the petitioner/ accused is that the Court below without assigning any reason passed the impugned order and hence, he prays to permit the petitioner/ accused to further cross-examine P.Ws.1 to 4 on the ground that the previous Advocate on record did not cross-examine the witnesses properly.

4.

This aspect of the case was elaborately dealt with by the Court below. Change of Advocate cannot be a ground to recall witnesses for further cross-examination. No valid reason is assigned. Hence, the criminal petition is devoid of merit and is liable to be dismissed.

5.

Accordingly, the Criminal Petition is dismissed.

Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
