This Criminal Petition is filed by the petitioners/A.2 and A.3 under Section 438 of Cr.P.C. for grant of anticipatory bail to them in Crime No.26 of 2017 of Somasila Police Station, SPSR Nellore District, registered for the offences punishable under Section 379 I.P.C., Section 21(1) of the Mines and Minerals (Development and Regulation) Act, 1957, Section 3 and 4 of the Prevention of Damage to Public Property Act, 1984 and the contravention of Rule 9(B) of Sub.No.(1)(3)(4) of the Andhra Pradesh Minor Minerals Concession Rules, 1966.

Heard the learned counsel for the petitioners/A.2 and A.3, learned Additional Public Prosecutor representing the respondent-State and perused the record.

The learned Additional Public Prosecutor, on instructions, would submit that the petitioners/A.2 and A.3 were issued notice under Section 41-A of Cr.P.C. in this subject crime and pursuant to that, the petitioners/A.2 and A.3 have furnished the sureties for their appearance in terms of the notice. Under these circumstances, there is nothing to determine in this petition. Therefore, the further proceedings in this matter are closed.
