HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.13837 OF 2018 ORDER:

The petitioner/A3 seeks to quash the proceedings against him in Crime No.1389 of 2018 of L.B.Nagar Police Station, Rachakonda, registered for the offences under Sections 323, 504 r/w 34 IPC and Section 3(1)(r)(s) of SC ST POA (Amended) Act, 2015. Investigation is said to be pending.

Having regard to the nature of the accusation, this Court is of the considered view that the investigation shall go on to reach its logical conclusion. However, the investigating officer, during the course of investigation, shall scrupulously follow the procedure contemplated under Section 41A Cr.P.C. and also the guidelines issued by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1. The petitioner shall cooperate with the investigating agency for smooth completion of investigation.

Accordingly, with the above directions, this criminal petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
