This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ A.1 and A.2, for grant of bail in Crime No.369 of 2018 of Abdullapurmet Police Station, Rachakonda Commissionerate, registered for the offence punishable under Section 376D of I.P.C.

Heard the learned counsel for the petitioners/ A.1 and A.2, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

The learned counsel for the petitioners/ A.1 and A.2 would submit that the petitioners/ A.1 and A.2 are innocent persons and falsely implicated in this case. They were remanded to judicial custody on 21.11.2018. Entire investigation is completed and ultimately prayed to allow the application.

On the other hand, the learned Additional Public Prosecutor opposed for grant of bail to the petitioners/ A.1 and A.2. 5 .

As per the material placed on record, the petitioners/ A.1 and A.2 indulged in sexual intercourse with the victim without her consent, by wrongfully confining her in a room, in the month of June, 2018. Thereafter, they brought two other persons and those two persons also indulged in commission of sexual intercourse with the victim by threatening her. There are specific allegations against the petitioners/ A.1 and A.2 that they

made an attempt to sell the victim. The victim escaped with the help of one Bharathi and lodged a report with the police. There are specific and grave allegations of commission of heinous offence of rape on the victim by the petitioners/ A.1 and A.2. Investigation is in progress. The punishment prescribed for the alleged offence is stringent. Release of the petitioners/ A.1 and A.2 on bail would hinder the investigation. There are no justifiable grounds to allow this application. 6 .

Hence, the Criminal Petition is dismissed.

Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
