HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.46926 of 2018 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " ...... to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not finalizing the deathcum-retirement benefits of the petitioner's husband Late Shanthakumar, who died in fire accident as well as not considering the petitioner's case on compassionate ground as illegal, arbitrary, null and void and consequently direct the respondents to consider her case for appointment as well as disbursement of death-cum-retirement benefits......" Heard Mr.Jalli Kanakaiah, learned counsel for petitioner and the learned Government Pleaders for respondents.

It has been contended by the petitioner that her husband was employed as a Teacher with the respondents and while he was discharging his duties, he expired in a fire accident on 26.12.2017. Therefore, she submitted a representation to the respondents on 27.01.2018 requesting to consider her case for appointment on compassionate grounds and also to release death-cum-retirement benefits of her husband, but, so far, the respondents have not passed any orders on the said representation nor considered her case for appointment on compassionate grounds nor released death-cum-retirement benefits of her husband.

consider the representation submitted by the petitioner on 27.01.2018 and pass appropriate orders in accordance with law. Learned Government Pleader appearing for the respondents has contended that the case of the petitioner will be considered and appropriate orders would be passed on the representation submitted by the petitioner in accordance with law. This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 27.01.2018 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
