Heard learned counsel for the petitioner, learned Government Pleader for Panchayat Raj and Rural Development for respondents 1 and 3, learned Government Pleader for Revenue for respondents 2 and 5 and Sri K.K. Durga Prasad, learned Standing Counsel for respondent No.4. 2.

This writ petition is filed challenging the final notice dated 20.12.2018. During pendency of this writ petition, petitioner was served notice dated 22.12.2018.

On the last occasion, learned Standing counsel for the Gram Panchayat informs the Court that the notice dated 20.12.2018 is withdrawn and a fresh notice is issued on 22.12.2018.

Though the intention of the Gram Panchayat appears to be withdrawing the earlier notice, but a reading of the notice dated 22.12.2018, do not give such an impression. 5.

At this stage, both counsel agree that the notice dated 20.12.2018 be set aside, granting liberty to the Gram Panchayat, to take appropriate course of action in accordance with law. 6.
