HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.41446 OF 2017 ORDER:

This Writ Petition is filed seeking writ of mandamus declaring the action of the respondent No.1 in intending to demolish the house of the petitioner bearing H.No.26/528A1, situated in Sy.No.624/C, Railway Station Road, Nandyal under the guise of road widening, without following due process of law, as illegal and arbitrary.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Land Acquisition. Learned Assistant Government Pleader for Land Acquisition, on instructions submits that they will follow due process of law before acquiring the property of the petitioner. Recording the submission of the learned Assistant Government Pleader for Land Acquisition, this Writ Petition is disposed of directing the respondents not to evict the petitioner from the subject property, without following due process of law.

There shall be no order as to costs. As a sequel to the disposal of this Writ Petition, miscellaneous petitions, if any, pending shall stand dismissed.
