THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.40835 of 2017 ORDER:

The petitioner has been working as MPHS(F) at PHC Shayampet of Warangal (Rural) District and her husband is working as Assistant in the Oriental Insurance Company Limited (Public Undertaking) at Branch Office Hanamkonda. While so, a vacancy arose on 31.07.2017 at Regional Eye Hospital, Warangal, due to promotion and transfer of one MPHS(F) as PHN(NT). She submitted a representation in July, 2017, to the first respondent by submitting a copy to the second respondent. The first respondent sought remarks of the second respondent by Memo dated 16.08.2017. The second respondent also recommended transfer of the petitioner by his letter dated 07.09.2017 and for posting her at Regional Eye Hospital, Warangal, on spouse grounds.

The petitioner also states that when her case was referred to the Finance Department, the Finance Department also cleared her case. However, when she came to know about G.O.Rt.No.955, Health, Medical & Family Welfare (F1) Department, dated 24.11.2017, posting another MPHS(F) at Regional Eye Hospital, Warangal (Urban), on spouse grounds in the existing vacancy, the present Writ Petition is filed.

Learned Counsel for the petitioner submits that the request of the petitioner was processed till the final stage and at the final stage the third respondent is posted on same spouse

grounds as that of the petitioner and, in view of the same, the petitioner does not want to contest G.O.Rt.No.955, Health, Medical & Family Welfare (F1) Department, dated 24.11.2017, though the Writ Petition is filed challenging the said order. Learned Counsel further submits that the petitioner would be satisfied if an appropriate direction is issued to the first respondent to consider the representation of the petitioner submitted in July, 2017, which was processed for considering her case, by posting in any existing vacancy near Hanamkonda, where her husband is working, or in any other vacancy that may arise in the near future.

In view of the above, the Writ Petition is disposed of directing the first respondent to consider the representation of the petitioner submitted in July, 2017, and to pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
