HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.13844 OF 2018 ORDER:

This petition is filed by the petitioners/A2 to A6 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.218 of 2018 on the file of Judicial Magistrate of First class, Guntakal, Anantapur District. 2.

Heard.

Having regard to the fact that the charge sheet is filed and matter is coming up before the trial court for framing of the charges, this Court is of the considered view that the petitioners can approach the trial court and seek their discharge putting forth the defence pleas that are legally permissible to them, in which case, the trial court shall consider the same and pass an order on merits expeditiously. Having regard to the request made by the learned counsel for petitioners, the personal appearance of the petitioners/ A2 to A6 is dispensed with before the trial court except on the occasion when the trial court specifically requires their attendance.

Accordingly, with the above directions, this criminal petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
