HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.13870 OF 2018 ORDER:

The petitioners/A4 and A5 seek to quash the proceedings against them in C.C.No.914 of 2016 on the file of IX Metropolitan Magistrate, Kukatpally at Miyapur. The case was taken cognizance for the offences under Section 498A IPC and Sections 3 and 4 of Dowry Prohibition Act. 2.

Heard.

Having regard to the fact that the matter is now coming up for framing of the charges before the trial court, this Court considers it apposite to direct the petitioners to approach the trial court and seek for their discharge putting forth the defence pleas that are legally permissible to them, in which case, the trial court shall consider the same and pass an order on merits expeditiously. Having regard to the fact that the petitioners are married women, their appearance before the trial court is dispensed with except on the occasions when the trial court specifically requires their attendance. 4.

Accordingly, with the above directions, this criminal petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
