THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION No. 6738 OF 2017 O R D E R:

This Civil Revision Petition is filed against the docket order, dated 18.08.2017, passed by the learned Senior Civil Judge, Anantapuramu, in I.A.No.573 of 2017 in O.S.No.386 of 2017 attaching the petition schedule property conditionally. Learned counsel for the petitioner-defendant submits that on behalf of the petitioner, Vakalat came to be filed only on 31.07.2017 and in the process, the petitioner was not aware of the order passed by the Court below on 14.07.2017 directing the petitioner to furnish security for the suit amount within 48 hours. Therefore, the petitioner is deprived of opportunity and thereby, the order under revision is passed in violation of the principles of natural justice and the provisions of Order 38 Rule 1 C.P.C.

It is to be noted that it is the responsibility of the petitioner and his counsel to verify the record and take necessary steps. The petitioner has failed to take necessary steps and even today, he is not coming forward before this Court to alley the fears with regard to the allegations made in the affidavit filed in support of I.A.No.573 of 2017.
