THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.39830 OF 2017 ORDER:

When the matter is taken up, written instructions, dated 24.11.2017, furnished by the Sub-Inspector of Police, Jubilee Hills Police Station, Hyderabad have been placed on record by the learned Government Pleader for Home. The said instructions read as under:

"It is humbly submitted that pursuant to the complaint of the 6th respondent, the respondent No.3 Station House Officer, Jubilee Hills Police Station, Hyderabad called the petitioner as well as the 6th respondent for the purpose of enquiry and necessary action. The petitioner did not approach the 3rd respondent. The 3rd respondent enquiry revealed that there is a civil dispute between the petitioner as well as respondents 4 to 7 herein with regard to the house bearing No.8-3-228/29, situated at Rahmathnagar, Yousufguda, Hyderabad. As the matter relates to civil in nature, hence the 3rd respondent suggested the 6th respondent to approach the concerned civil court for redressal. In this connection the same was entered into the General Diary dated 07.11.2017.

It is humbly submitted that the contentions of the petitioner that the respondent No.3 - Station House Officer, Jubilee Hills Police station, Hyderabad has interfered with the civil dispute between the petitioner and the respondents 4 to 7 in respect of the house bearing No.8-3-228/29, admeasuring 227 sq.yards, situated at Rahmathnagar, Yousufguda, Hyderabad and threatened to vacate the said house is incorrect, baseless, far from truth and has been created for the sake of filing the present writ petition.

It is incorrect to say that at the instigation of the respondents 4 to 7, the 3rd respondent tried to

dispossess the petitioner from the house bearing No.83-228/29, situated at Rahmathnagar, Yousufguda, Hyderabad and threatened to hand over the said house to the respondents 4 to 7, or else the 3rd respondent will implicate the petitioner in false case and the possession of the said house would be handed over to the respondents 4 to 7, hence denied.

It is submitted that the petitioner herein instead of cooperating with the enquiry on the complaint of the 7th respondent dated 07.11.2017, filed the present Writ Petition with baseless allegations.

It is submitted that the 3rd respondent never interfered with the civil dispute between the petitioner and the respondents 4 to 7 with regard to the house bearing No.8-3-228/29, situated at Rahmathnagar, Yousufguda, Hyderabad and never threatened to vacate the said house as alleged by the petitioner herein.

It is humbly submitted that the contentions of the petitioner against the 3rd respondent - Station House Officer, Jubilee Hills Police Station, Hyderabad is incorrect, baseless, far from truth and invented for the purpose of filing the present Writ Petition." 2.

A request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.

Accordingly, the Writ Petition stands disposed of, by placing on record the aforesaid instructions furnished by the Sub-Inspector of Police, Jubilee Hills Police Station, Hyderabad. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
