This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner-A2, for grant of anticipatory bail in the event of his arrest in Crime No.14 of 2013 on the file of Kesamudram Police Station/ CID Hyderabad, registered for the offences under Sections 420, 406 and 506 of I.P.C. and Section 156(3) of Cr.P.C.

Heard the learned counsel for petitioner-A2, learned Additional Public Prosecutor representing the respondent-State and perused the record.

Learned counsel for the petitioner-A2 would submit that the petitioner is an agent of A1. He is not responsible for any fraud or mismanagement alleged to have been committed by A1 and ultimately prayed the Court to allow the application. 4 .

On the other hand, the learned Additional Public Prosecutor opposed the grant of anticipatory bail to the petitioner-A2. 5 .

As per the material placed on record, A1 along with nine others started a money scheme. About 200 members joined in the said scheme and an amount of Rs.12.00 crores was alleged to have collected. The petitioner-A2 is the agent of A1 and collected Rs.50,61,000/ -. The establishment made by the petitioner and other accused is not a legal entity. The petitioner-A2 and A1 have no authority to collect money from the members of L.L.B.C.M.

Trust. It cannot be said that there is no commission of fraud, mismanagement and inducement. The matter requires thorough investigation. Release of the petitioner-A2 on bail would not only hinder the investigation, but there is also possibility of disappearance of material evidence. In view of the above, it is not a fit case to allow the present petition.

The Criminal Petition is, accordingly, dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
