This writ petition is filed to declare the action of respondents 2 to 4 in trying to mutate the names of unofficial respondents 5 to 7 in revenue records in respect of 1/5th share of the petitioner out of lands to an extent of Ac.23.94 cents in Sy.No.209, Ac.11-29 cents in Sy.No.228/1, Ac.6-92 cents in Sy.No.227/2 and Ac.1-12 cents in Sy.No.226/12 and a house in Bit-II situated at Babametta, Vizianagaram as per decree in O.S.No.41 of 1986 as illegal and consequently to enter the name of petitioner in revenue records in respect of his 1/5th share in the subject lands.

Admittedly, civil disputes are pending between the petitioner and unofficial respondents as rightly pointed out by learned Assistant Government Pleader for Revenue. He also submits that the petitioner has made a representation, dated 26-11-2018 to the District Collector, who is not the competent authority. When civil litigation is pending between the petitioner and unofficial respondents, the petitioner cannot again maintain the present writ petition.

In view of the same, this Court is not inclined to entertain the writ petition. However, it is open for the petitioner to avail alternative remedy available to him under law.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
