THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.41939 of 2017 ORDER:

This writ petition is filed seeking a Writ of Mandamus to declare the action of the respondent No.2 in rejecting the claim of the petitioner for inclusion of his services as Nominal Muster Roll (for short, NMR) from 17.10.1964 to 16.06.1977 despite producing the records for conferring the enhanced pensionary benefits granted in E.O.O.(HRD)Ms.No. 229, dated 21.08.2010 and the action of the respondents in not acting upon the representation of the petitioner, dated 24.01.2017 as arbitrary and illegal. A consequential direction is sought to re-fix the pension of the petitioner by taking into consideration the services rendered by him as NMR during the above said period.

Heard Sri Ch. Samson Babu, learned counsel for the petitioner and Sri M.Ravindranath, learned Standing Counsel for the respondents. It is the case of the petitioner that he was initially appointed as NMR on 17.10.1964 and he was continued as such up to 16.6.1977. Later on, the services of the petitioner were regularized and he was promoted as Assistant Lineman and he retired from service on attaining the age of superannuation on 31.05.2004.
