THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.47052 OF 2018 ORDER:

When the writ petition is taken up for hearing, learned counsel for the petitioners contended that the candidates who have secured less marks than the petitioners are being selected as Junior Panchayat Secretaries and that to strengthen his arguments, the learned counsel has pointed out that the petitioners have secured 53.50 marks and 44.25 marks, respectively, in the written examination, but the respondents have selected a candidate who has secured 37 marks and, therefore, the petitioners filed the present writ petition.

Learned Government Pleader appearing for the respondents, on written instructions, submitted that a candidate who secured 37 marks and is shown as selected to the post of Junior Panchayat Secretary, is a candidate belonging to Sports Quota, whereas the petitioners are General Category candidates. Learned Government Pleader also submitted that though the petitioners are claiming reservation under Sports Quota, they have not filed any documents in support of their claim under Sports Quota and, therefore, there are no merits in the writ petition and the writ petition is liable to be dismissed.

This Court, having considered the rival submissions made by the respective parties, is of the considered view that though the petitioners have secured more marks than a candidate who was selected under Sports Quota, the cases of the petitioners could not be considered, as they failed to submit necessary documents claiming appointment under Sports Quota. In view of the above said lacuna on the part of the petitioners in not filing any documents in support of their claim under Sports Quota, the

cases of the petitioners could not be considered for appointment under Sports Quota ahead of a candidate who had secured 37 marks and got selected under Sports Quota. There are no merits in the writ petition. The writ petition is accordingly dismissed. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
