THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE MS. JUSTI CE J.UMA DEVI WRI T PETI TI ON NO.42692 of 2017 ORDER: (per SK,J) Challenge in this writ petition is to the docket order dated 01.12.2017 passed by the Debts Recovery Tribunal-II, Hyderabad, in S.A.No.1475 of 2017. By the said order, the Tribunal directed the petitioners herein, the applicants in the S.A., to deposit 10% of the total outstanding dues claimed by the Andhra Bank on or before the time and date of the auction, i.e., 3.00 PM on 04.12.2017, and 15% of the total outstanding dues within two weeks thereafter. Sri B.Chandrasen Reddy, learned counsel for the petitioners, would state that his clients had complied with the first limb of the condition and deposited 10% amount within time.

He however seeks extension of time to deposit the balance 15% amount in terms of the direction of the Tribunal. Learned counsel fairly concedes that no attempt was made by the petitioners to seek suuch extension of time before the Tribunal. As it is for the petitioners to first approach the Tribunal with this prayer, we are not inclined to entertain this writ petition. The writ petition is accordingly dismissed leaving it open to the petitioners to move an appropriate application before the Tribunal, if they seek extension of time on valid grounds to comply with the direction of the Tribunal.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
