THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.47097 of 2018 ORDER:
The grievance of the petitioner is that the revenue authorities are not considering his representation dated 28.11.2017 whereunder he raised objections to the grant of pattadar passbooks and title deeds in favour of respondents 5 and 6 in relation to the land admeasuring Acs.5.00 guntas in Survey Nos.47/2 and 44/1 of Dilawarpur Village, Damaracherla Mandal, Nalgonda District.
In the light of the order proposed to be passed by this Court, it is not necessary to put respondents 5 and 6 on notice or afford them an opportunity of hearing. That apart, it would not be within the jurisdiction of this Court to decide the inter se private disputes between the petitioner and respondents 5 and 6 in a writ petition.
The Tahsildar, Damaracherla Mandal, Nalgonda District, furnished written instructions to the learned Government Pleader for Revenue, State of Telangana, wherein he stated that O.S.No.170 of 2016, a partition suit, filed by the petitioner is pending consideration before the learned Senior Civil Judge, Miryalguda, and therefore, the application filed by the fifth respondent for mutation has been kept pending. He further stated that as the suit is pending trial before the civil Court, he did not take any action on the application of the fifth respondent and no pattadar pass books have been issued on the strength thereof.
In the light of the stand taken by the Tahsildar, Damaracherla Mandal, Nalgonda District, no orders need to be passed in this writ petition.
The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs. ____________________ JUSTICE SANJAY KUMAR Date:01.02.2019 GJ
