ORAL ORDER:

Heard learned counsel for petitioners and learned standing counsel for respondent corporation.

According to petitioners, land in survey No.982 belongs to a person by name B Jagannath Rao. The said land was purchased by different vendors and it was mutually agreed upon that 30 feet road is to be left out in East and West sides. It appears said B Jagannath Rao also donated some land to respondent corporation. Petitioners now allege that respondent corporation is encroaching into their land in excess of the land donated to it by said B Jagannath Rao. 3.

A bare perusal of the averments made in the affidavit filed in support of the writ petition would show that there are rival claims to some extent of the land. This Court in exercise of powers of judicial review under Article 226 of the Constitution cannot go into the disputed questions, more particularly with reference to title to the property in issue. As it is a civil dispute, aggrieved parties have to avail the remedies available under law, if so advised. Accordingly, the writ petition is dismissed.
