THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.43750 of 2017 ORDER:

The case of the petitioner is that he was temporarily appointed by the second respondent on 25.03.1985 as Thoty in ESI Dispensary, Old City, Hyderabad. He joined the duty on 10.04.1985. His services were subsequently regularized with effect from 10.04.1985 by letter dated 31.03.1990. He states that he is a physically handicapped person and rendered more than 30 years of service. His wife expired and he is having two children. As a watchman he is entrusted with night duties and it has become difficult for him to attend the night duties with two grown up adolescent children. In those circumstances, he submitted a representation to the third respondent on 22.01.2014 for posting him as attender, and when the same was not considered, the present Writ Petition is filed.

Since the entrustment of duties is within the domain of the second respondent, this Court is not inclined to grant any direction either in support of the case or opposing the case of the petitioner. But, in view of the difficulties expressed by the petitioner in his representation dated 22.01.2014, the second respondent is directed to take necessary action on the said representation by issuing suitable instructions. At this stage it is noticed that the representation filed by the petitioner was addressed to the Joint Director.
