DURGA PRASAD RAO WRIT PETITION No.41523 OF 2017 ORDER: (ORAL) (Per Suresh Kumar Kait, J) Vide the present petition, petitioner seeks direction to the 1st respondent herein to forthwith pay Rs.9,21,77,697.75 ps., as on 31.03.2017 as per the unanimous arbitration award passed by the arbitral tribunal on 15.12.2016. It is not in dispute that E.P.No.7 of 2017 filed by the petitioner is pending on the file of the IV Additional District Judge, Visakhapatnam, from April, 2017, however, till today, the said E.P., has not been disposed of. In view of the facts and circumstances of the case, without going into merits, we, hereby, direct the learned IV Additional District Judge, Visakhapatnam, on whose file E.P.No.7 of 2017 is pending, to dispose of the said E.P., within four weeks from the date of receipt of this order, after giving opportunity to both sides.

The writ petition is accordingly disposed of. No order as to costs. As a sequel, miscellaneous petitions, if any, pending in the appeal, stand closed.
