THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON NO.47088 OF 2018 ORDER: (per SK,J) The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, the petitioner pray that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or direction especially one in the nature of Writ of Mandamus declaring the action of the 3rd respondent-University in not giving posting orders to the petitioner, though he has given joining report dated 24.12.2018 to the 3rd respondent-University, pursuant to the Proceedings No.116/Registrar/SKLTSHU/2015 dated 26.07.2018 relieving the petitioner and others by the 4th respondent, as illegal, unconstitutional, contrary to law and opposed to the principles of natural justice, and consequently direct the 3rd respondent-University to give posting order to the petitioner forthwith and pass such other and further orders to meet the ends of justice.'

It is an admitted fact that the petitioner was allocated to the third respondent-University in the State of Andhra Pradesh but seeking retention in the fourth respondent-University in the State of Telangana, he filed W.P.No.27393 of 2018. The said writ petition is stilling pending consideration and no interim orders have been granted therein. While so, his present grievance is that the third respondent-University is not issuing him posting orders though he submitted his joining report. As the petitioner is yet to secure any order in W.P.No.27393 of 2018 and has admittedly been allocated to the third respondent-University in the State of Andhra Pradesh, he is duty-bound to serve there pending disposal of his other writ petition.

The writ petition is accordingly disposed of directing Dr.Y.S.R.Horticulture University, the third respondent, to issue posting

orders to the petitioner within one week from the date of receipt of a copy of this order.
