THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.13904 OF 2018 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C), is filed by the petitioner/Accused, for grant of anticipatory bail in the event of his arrest in connection with Crime No.302 of 2018 of Halia (Alwal) Police Station, Nalgonda District, registered for the offences punishable under Sections 409 and 420 IPC.

Heard learned counsel for the petitioner/Accused, the learned Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioner/accused would submit that during tenure of the petitioner/accused as Bank Manager in State Bank of India, Halia (Alwal) Branch, Nalgonda District, no irregularity was committed by him; that after 1 1⁄2 year delay, a false case is foisted against the petitioner; that the petitioner is suffering from health problems and ultimately prayed to allow the application.

Learned Additional Public Prosecutor opposed the grant of bail to the petitioner/accused.

As per the report lodged with the police, this petitioner/accused worked as Branch Manager in State Bank of India, Halia (Alwal) Branch from 22.08.2013 to 25.05.2017. While discharging duties as Branch Manager in the said Bank, the petitioner indulged in sanction of loans, without inspecting the

units, to the wives of police and Home Guards. There are specific and grave allegations against this petitioner that he accepted bribe through middleman and sanctioned loans to a tune of Rs.63,25,350/-. Thus, he perpetuated fraud on the bank. The amount involved is high. The specific allegation of sanctioning loans to different persons, without any authority in connivance with the outsiders to make illegal ratification, is violating regulations and procedure of the Bank.

Under these circumstances, the health problem cannot be a ground to grant bail to the petitioner. The Criminal Petition is devoid of merit and is liable to be dismissed. 7.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
